Terms of Service

Last Updated: October 2024

These Terms of Service ("Terms") govern your access to and use of The Visa Orchestrator platform, services, and software provided by The Visa Orchestrator ("we", "us", or "our"). By accessing or using the platform, you agree to be bound by these Terms.

1. Business-to-Business SaaS Platform

The Visa Orchestrator is a Business-to-Business (B2B) Software-as-a-Service (SaaS) platform designed to orchestrate and manage visa applications, workflows, and document collection. Our platform is provided for use by visa agencies, corporate mobility teams, travel operators, and other organizations ("Enterprise Clients").

2. No Legal Advice or Immigration Guarantee

CRITICAL DISCLAIMER: We are a software technology provider, not a law firm, legal agency, or government entity. The Visa Orchestrator does NOT provide legal advice, immigration consultations, expert legal guidance, or tailored visa strategies. The use of our platform does not guarantee the approval or issuance of any visa, permit, or authorization by any government authority. All decisions regarding visa approvals are strictly at the discretion of the respective government authorities. Enterprise Clients are solely responsible for ensuring the accuracy of all submitted applications and compliance with immigration laws.

3. Subscriptions and Fees

Access to certain features of the platform may require a paid subscription, enterprise licensing agreement, or volume-based corporate agreement. Fees are billed in advance on a recurring basis or per-application basis, as specified in your applicable order form or agreement. All fees are non-refundable unless otherwise required by law.

4. Acceptable Use

You agree not to use the platform to:

  • Submit fraudulent, forged, or unlawfully obtained documents or passports.
  • Violate any local, state, national, or international law, including immigration and data protection laws.
  • Attempt to gain unauthorized access to our encrypted vaults, databases, or partner networks.
  • Resell, white-label, or sublicense the platform without an explicit enterprise licensing agreement.

5. Account Termination

We reserve the right to suspend or terminate your account and access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the platform will immediately cease.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Visa Orchestrator, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party on the platform; (iii) any delays, rejections, or denials of visa applications by government bodies.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
